Fraud charges may nix Viable deal

Prospective buyer mulls acquisition of Rockville deaf-services firm

A spokeswoman for the New York company that tentatively agreed to purchase beleaguered Rockville deaf services business Viable said this week it is now “considering its options” after Viable president John T.C. Yeh, three other Viable executives and leaders of six other companies nationwide were charged in a six-count indictment with conspiracy to defraud the federal government out of tens of millions of dollars.

Snap!VRS of Pearl River, a video relay service company, is “working through all the complications that have taken place since the indictments,” said Maureen Ellenberger, vice president of marketing. Snap!VRS agreed to acquire Viable in August, but the deal has not been finalized, she said.

Snap!VRS executives released a statement saying they were “disappointed at the magnitude of unethical behavior in the use of video relay service which was revealed by the news of the FBI and Justice Department investigation. While Snap!VRS was not involved in the investigation, we are of the strong public stance that the harm done to relay consumers by the wrongful acts of some individuals is unacceptable, but these acts do not change the critical need for this technology for deaf people.”

The national investigation concerns a Federal Communications Commission program designed to help deaf and hard-of-hearing people communicate with hearing persons.

Besides Viable, companies whose executives were indicted on similar charges were Master Communications of Las Vegas; KL Communications of Desert Hills, Ariz.; Mascom of Round Rock, Texas; Deaf and Hard of Hearing Interpreting Services of New York City; Innovative Communication Services for the Deaf of Miami Lakes, Fla.; and Deaf Studio 29 of Huntington Beach, Calif.

These executives fraudulently billed the FCC about $390 an hour to interpret calls between deaf and hearing people, federal prosecutors said. The calls, generally referred to as “r calls,” “rest calls” or “run calls,” were illegitimate calls often made by friends or relatives that would be billed to the FCC’s video relay service fund, officials said.

Viable is the central company in the alleged scheme, directly linked via business arrangements to five of the six other companies involved. Master Communications, KL Communications, Mascom, Deaf and Hard of Hearing Interpreting Services and Innovative Communication Services for the Deaf all operated call centers for Viable that generated and processed a large volume of fraudulent calls, according to the indictments.

“These defendants are alleged to have generated fraudulent call minutes by making it appear that deaf Americans were engaging in legitimate calls with hearing persons, when in reality, the defendants were simply attempting to steal money from an FCC program that is funded by every single American who pays their telephone bills,” Lanny A. Breuer, assistant attorney general of the Justice Department’s Criminal Division, said in a statement released Nov. 19. The FCC program is funded through a tax on regular telephone service.

The FBI’s Washington field office, U.S. Postal Inspection Service and FCC Office of Inspector General conducted the nationwide probe.

Allison Polk, a Viable spokeswoman, referred questions to Ellenberger.

Other Viable executives charged are vice president of corporate strategy Joseph Yeh, a brother of John Yeh; assistant vice president for business development Anthony Mowl; and human relations manager Donald Tropp. The charges also include submitting false claims and mail fraud.

Viable has been under a cloud since a June visit by federal investigators. The company also has been hit with lawsuits filed in federal and state courts by employees seeking back payment of wages.

This week, Nicholas Woodfield, who is representing 114 plaintiffs in a class-action lawsuit filed in U.S. District Court in Greenbelt by former and current Viable employees seeking back wages, filed a motion for a default judgment against John Yeh, Joseph Yeh and Mary Yeh, John Yeh’s wife. The filing said that Joseph Yeh had requested 20-day extensions twice to answer the complaint on behalf of the defendants, the last one being in mid-October. The Yehs had failed to respond to the complaint as of this week, according to the motion.

It’s unclear what impact the indictments will have on the civil case, Woodfield said Wednesday.

“I’m sorry for my clients’ sake that [Viable executives were] indicted because that is not a boon to them in their efforts to receive unpaid wages,” Woodfield added. “Whether it will be significant or a bump in the road remains to be seen.”

Bethesda lawyer John Pierce, who is listed as a representative for Viable in the civil class-action lawsuit, said in an e-mail this week that he was checking with his clients to see if they wanted to respond to a reporter’s questions.

‘Calls should look good …important not raise red flag’

The evidence against Viable executives in the FCC case includes an e-mail allegedly sent by John Yeh in July 2007 to Larry Berke, the owner of KL Communications, which ran a call center for Viable, according to the federal indictment. Berke, of Phoenix, was also among 26 people across the country charged in the case.

“Your calls should look good — not too perfect and too long hours,” Yeh wrote, according to the indictment. “Important not raise ‘red flag’ for FCC to see it. Understand me?”

John and Joseph Yeh would pay friends to generate the phony calls, officials said.

“For example, paid callers frequently called podcasts — which were prerecorded messages, like a recording of a radio program or a person reading a novel — and would routinely instruct the not to actually interpret the calls,” the indictment said.

John and Joseph Yeh used Mowl and Tropp to recruit relatives and friends to make illegitimate calls, officials said. Mowl and Tropp would be paid $30 an hour of phony calls and in turn pay people $20 to $25 per hour to make the calls, according to the indictment.

In a little more than a year from the fall of 2007 to last January, the Yehs paid Mowl and Tropp at least $162,000 to pay the illegitimate callers, and those fraudulent calls alone resulted in $2.1 million to be billed to the federal government, the indictment said. The Yeh brothers would instruct Mowl, Tropp and others to destroy documents to cover up their alleged misdeeds, officials said.

The Yeh brothers would also partner with KL and other call centers, and encourage the owners of those centers to make the bogus calls, officials said. The Yehs would instruct the owners “how to make the run calls appear legitimate” by varying the call lengths, numbers and Internet protocol addresses, the indictment said.

Snap!VRS: Critical to retain services

Because video relay services allow deaf people to have phone conversations in the comfort of their homes, rather than having to communicate via sign language in person, the technology creates economic opportunities for deaf people that were not previously possible, Snap!VRS executives said.

“Given the transformative benefits and opportunities that VRS has brought to deaf people, it is critical for Snap!VRS and other VRS companies to continue an ongoing dialogue with the FCC and consumer organizations to keep this irreplaceable service effective for relay consumers,” Snap!VRS executives said in a statement. “Snap!VRS will continue to operate as it has in the past, conducting its business with the highest priority placed on ethical standards and customer service.”

FCC Chief of Staff Edward Lazarus called the case both a tragedy and opportunity.

“The tragedy is the unfortunate truth that a significant number of unscrupulous individuals, at great cost to the nation, have preyed on a very important program for delivering essential telecommunications services to persons with hearing disabilities,” Lazarus said in a statement. “The opportunity is the chance to reiterate our commitment to the VRS program and to follow through on efforts, already begun at the FCC, to safeguard the program against further waste, fraud and abuse.”

John Yeh has long been involved with organizations that advocate for the deaf community, such as the National Asian Deaf Congress and National Deaf Business Institute. He was a trustee of Gallaudet University of Washington, D.C., which specializes in education for deaf people, for more than a decade.

In January, Deaf Life, a monthly national magazine, honored Yeh as Deaf Person of the Year. Last year, The Gazette of Politics and Business named Yeh one of its “25 CEOs You Need to Know” and Viable as one of its “Exceptional 53” businesses and nonprofits.

A native of Taiwan who immigrated to the U.S. as a teenager, Yeh helped form a Rockville software engineering and integration company before co-founding Viable in 2005. The company grew from a handful of employees to more than 240 but has shed numerous employees and closed call centers this year. Yeh’s son, Jason, and a daughter, Mei Kennedy, both work for Viable but were not indicted.

About a year ago, speaking through a deaf interpreter to a Gazette reporter, John Yeh gave little indication of any trouble.

“The company is still fairly new,” he said then. “We have to be careful about what we do.”

    a few friends of mine are still waiting for a refund from Viable, that they bought during the DSC conference in Vegas this past July,, they told her to be patient she would get her money back,, yea right doesn’t look like its gonna happen any time soon,, its a crying shame that a deaf biz felt it was neccessary to try to rip off their customers then try to plead DUMB and pretend they didn’t know the rules B.S…its sad but apparently we will have to wait and see what the Federal courts decide to do with these greedy SOB’s

    John T.C. Yeh was a member of Kappa Gamma the cult fraternity. Good news is that he is out of Deaf Community because he caused everyone the embrassment and pain. I thought he was a nice guy but not. So many people suffer the deep debts and we are at the risk that it could take a “dramatic crisis for this country. John and his greedy friends are hurting our country and Deaf community so badly. I thought he was our brotherly friend but for what he had done to everyone, I lost my respect for him.

    What about Bonheyo and Bonheyo LLC (Bridget and Jerry Bonheyo)? They hired employees to make illegitmate calls, too. Birnbaum Interpreting Services hired deaf people to do presentations and then actively asked deaf people to call through VRS to earn minutes. We wonder why they are getting away with it while Viable got caught.

    It has nothing to do with the Kappa Gamma Fraternity. Several of the 26 charged people have belonged to other Greek organizations; however, the most important point is I must emphasize that none of these Greek organizations have nothing to do with this unfortunate situation.

    Kappa Gamma Fraternity was a major factor to Viable, Inc. Let’s count….4-5 arrested who are Kappa Gamma Fraternity. About 10-15 more hopeless, inexperience, and hard party type guys worked closely with Yehs. They didn’t contribute the company that much. In return, they got a reward job, good pay, clubbing, and gambling.

    How could Viable benefit from those people? Should I name them all?

    Oh wait, founders, and others are Kappa Gamma Fraternity and they certainly didn’t give a crap.

    That is a good chunk of money being thrown at people and business who don’t deserve it. They have mislead others and themselves for so long. They chose to benefit themselves at the expense of the deaf community. I say to have them prosecuted to the full extent of the law to set example for the VRS industry to ensure integrity so it can benefit those who really use it for legitimate purpose.

    If the article is valid. The free ride is over. Now pay the Viable employees and return every cent that has been defrauded back to FCC! No more sugarcoating about their actions!

    It is sad to see it to happen. Remember Mr.Yeh helped the deaf in Las Vegas to get the large donation money to cover the loss in DSA business. We should thank him for that. But too bad Mr. Yeh could not get our help in return. It is SAD.

    AJA what are u talking about ??????????? He donated MONEY that probably was ripped off from the deaf customers he promised to refund money to,, I am NOT impressed with his “large” donation.

    Because of what Viable did, other VRS agencies are going to have to work 2 or 3 times harder to gain trust of their clients and future clients…plus handle the over flow.. Viable is probably going to loose alot of customers.. so they will be scurring around to find a better service.. They Yeh brothers are like rats on a sinking ship!!!!

    Viable isn’t the only VRS company defrauding the government. This defrauding includes ripping off every single American who pays this surcharge on their phone/cell/pager bills. I find it all disgusting and on top of it all, more disgusting that they only went after the most vulnerable VRS! Sorenson got slap on hand for something similar. Oh wait, I forgot, Sorenson have lobbying connection. What about other VRS besides Sorenson and Viable??? SHEESH.

    Aja, Mr.Yeh stole a lot of funds from the FCC and other governments. He made himself look like a free money giver. He did not donated anything out of his pocket. I bet that he gave a lot of money to Kappa Gamma Fraternity too. What’s about his employees waiting for him to pay them? A customer was not happy with his laptop and asked for the refunds. John promised but he did not give a dime to him. What was going on? He is not a hero.

Kappa Gamma (KG) fraternity at Gallaudet University has a long time unspoken history….humiliating, puerile and dangerous, fraternity hazers keep claiming victims. The punishment was both tedious and cruel. KG ordered pledge member to stand in a meeting room for several hours without moving then he collapsed and got head injuries. So many members got scars, bruises, bleeding, and damages when they were forced to do something or obey the bullshit KG! Plenty pointless brutality often happened and they still do that most people don’t really know. I don’t ASSume because the few past members broke the code of silence, I clap for them to speak out. A few years ago KG got four year suspension for what they had done to a member. So your talk is shit!

    Those stories are occurred before 2000 (few years?). The brutal punishment were practiced everywhere in frats and sorority.
    As I see, those who are against KG or whatever, those were rejected ones.
    You must be the rejected one or being known that you will be not accepted.
    Remember that people tend to remember the negatives not positive moments.
    Rant all you want, KG wont go away and will continue their contributes to deaf community after you are dead.

    FYI, when I was undergrad student at a state college, I learned that many frats did a group rape or date rapes by spike the drinks and continue the cruelty in their pledge programs. While I was graduate student at Gallaudet University, I never hear any problem from Kappa Gamma and other greeks. Gallaudet did good job educating those groups to revamp their programs as I was working at Campus Activities. All of them give excellent hours in community services. Also most of them were active leaders during Gallaudet Protest in 2006. Rethink please.
    Mike, your comments were very old and outdated because they did service their time and reformed their methods.
    Please look in current time and reanalyze the situation which we have right now.

    Assume, Only problem is the KG wouldn’t let it go if victims connected really good and would come back later and point at KG. No unwritten rules of school pain with pride and honour like yesteryear. It is not old, it is not about age but history. The wounds are still fresh. Sure KG might not go away but the history will never go away too. The long history of KG is old and new. More troubling still, the KG has either denied the problem or failed to deal with it effectively. It has a history of covering up. I was not rejected but I rejected KG. What an ass!

    To ???, unless you are blind or loyal to KG, that is an understanding story but dumb! You must be one smart one, embarrassed by the behavior of the KG’s members.. not very good margins, those… and what’s the more? You’re bullshitting that you “never” heard.

    KG members are insidious people. I ain’t surprised that they told FBI about Mowl and Tropp’s wrongdoing when they recruited them.

    Some “run” callers who made on the top are KG. They worked very hard for Mowl and Tropp.

    Mostly, They don’t mind when Yeh took advantage of them.

    Anyway, Mowl and some Yeh went to DPHH in DC and Gala at Union Station, lately. They were seen acting like nothing happen and poisoning his “kg” friends’ word.

    The Kappa Gamma is not the issue here, the issue is the 26 individuals who have been arrested, regardless if they were KG members or former TeenAge Ninja Mutant turtles, I don’t give a shit, the point is these 26 arrested were not arrested for the fun of it, the FBI and who ever busted their sorry asses did not arrest them for fun but they had evidence on them or they would not have busted them, now they did not arrest them and say WE ARE ARRESTING U BECAUSE U WERER FORMER KG memebers, no they arrested them based on what they did and with the information they uncovered..sorry most of those 26 have college degrees so they can not plead DUMB and PLAY innocent.

    I have witnessed they hired KG and PKZ members over the experienced workers who could contribute Viable, Inc 500 times better. Ultimately, those experienced workers could save Viable, inc from this mess.

    John Yeh, himself, is not really smart guy. Joesph shaped John’s career. John cannot write a letter that long. He needs someone to do it for him all time, literally. He usually makes more than 30 attempts to create a single video that lasts only a minutes.

    Yeh gave KG and PKZ a reward jobs when they are inexperienced at them. For instance, what do social worker, and historian have to do with marketing and human resource? Those guys got a rewards job, automatically, because they are KG and PKZ while others have mastered at those careers.

    I am not surprised if FBI has been asking KG and PKZ for vital information on Viable and Yeh. Those people treats Viable like a college. No, I am serious.

    I have heard from John Yeh’s third person connection said that John Yeh is EXTREMELY upset about his true friends who have betrayed him. Those guys will testify against him. You will be very, and very surprised when we learn something new from media on incoming trial. The trial could last for at least a year due to more messes that need to be uncaged.

At least in the KG they still have a thing called “respect”. This situation could be the crime genre or not. There is something very, very suspicious here. That’s why some of us bring this up that FBI might or might not know.

Yes they both made fake calls BUT it gave many Deaf people jobs when they were and still are today limited for DEAF PEOPLE!My uncle is Deaf and related to Mr.Yeh and even he couldn’t find a job with out hardships even NOW! What America doesn’t understand is that John and Joseph gave people oppertunities! John Yeh is not power-hungry if that what you guys think they are. To me this SIMILAR to Rockfeller during the 1900’s only Yeh is not a thief! And the government let Rockfeller do his own thing but now they get all tough on this man? I don’t think so.     I read your comment and i was surprised at the sentence that John is not really smart. Well guess what not all people are smart and people will need help. I bet you have to have or had help just like John had. John is a great guy who loves his family especially his grandkids. the only thing he gave you was a JOB when it was and still limited in America, He brought people closer even if they were ‘fake calls’ it gave you money to support you.     I don’t care if John Yeh was a fraternity members. I just want to see justice w the VRS abuse since they been stealing over 100 million dollars which the tax payers are paying for it. Viables, Bonyeo, Purple were all busted for VRS abuse some of them shut down but I think the government should take all 26 people and throw their ass in jail since they all pleaded guilty. I am hearing that Yeh is postpone till August of 2011. He have been a free man for two years and I find the FCC doing a lousy job on their end. If you look at the percentage what college all theives went too. They should cut the Federal Funding of Galladuet because they take money from thieves. Someone got to recoup the tax payers money. I think the FCC monies that they get from the company shouldn’t be charge until the monies is pay back from all VRS co.

    WAKE UP!!! I can’t believe the stupidity of the blogger who is defending John Yeh because he “gave opportunity” to deaf people. Sure, he gave them jobs…no question. But if it involved STEALING from U.S. taxpayers, does that make it right??? Get real! Quit feeling ENTITLED to that extent!

    Yes, deaf people do not have the same opportunities for jobs as hearing people. While it may sound politically incorrect, it’s a fact…deaf people represent 3% of the total population. While they shouldn’t be discriminated against, they shouldn’t be allowed to STEAL from the government either! Blind people don’t have the same opportunities as the majority of the population either; you wouldn’t want them flying airplanes or driving buses would you?? A disability is just that.

    I do feel bad for the deaf workers at Viable who actually did honest work as part of their daily jobs. There were many who obviously were not aware of the scam and did not participate in it. But to say John Yeh does not deserve prison is a JOKE! He STOLE money! He “played” the deaf community too. Of course he spread the money around…it was the only way to gain “support” and to expand his business which would eventually make him a fortune! Nobody becomes wealthy on their own, without spreading the wealth a little…

    I have the privilage of knowing John Yeh for many years and done business with him. He is gentle and kind He knows how much deaf community suffered with high unemployment, low wages, etc. John Yeh formed two companies to provide jobs to deaf. First company was 80 pct deaf employed. Viable I think 60 pct deaf employed.

    I see it with my own eyes. Do not make up lies about Yehs.

    On the one hand I do not actually want to get into the situation of the rip off of the US government or how the hearing impaired were taking advantage of through the fraudulent scheme which seemed to be at the instigation of John Yeh.
    I went to Gallaudet during the time period both Yeh and Larry Berke were students – this is between 1966 to 1971. Due to my being relatively new to the deaf community due to becoming deaf in early 1966 – I was not actually in the ASL community while there. In 1969 I was a cofounder of a fraternity that later became a chapter of Kappa Sigma at Gallaudet. Throught out my time there – there was always speculation among some of the Gallaudet students that KG was more of a gang than a fraternity. That comment actually appeared in the Buff & Blue (student paper) in I think 1970 or 1971 by an individual I know. It is no surprise that in this rip off the KG gang was front and center.
    Due to an odd chain of events I was actually Larry Berke’s roommate for 5 or 6 weeks in the summer of 1969 – I do not want to indicate that over 40 years later I am willing to say much beyond he seemed to be at that point in my life a very decent person. When one reads these various comments one gets the feeling Larry was minapulated and taken advantage of by John Yeh, also.
    I did not like John Yeh while I was at Gallaudet!!!

    For your information. It was two his employees, one is Vice President and other in Human Resources, both are DEAF (I mean the “D” ) took advantage of John’s trusted and kind heart and defraud his company by telling employees to make false calls to no one. Mowl advertised for jobs, Tropp in HR hires employees and tells them to make as many false calls for $$ in minutes. One or two employees hired felt something was wrong and not honest. That is how FCC finds out.

    John Yeh accepted responsibility because he admits for trusting his employees under him on what they were doing behind his back.

    John has a big heart and trusts deaf employees and gave them opportunity to earn living. His company in Rockville, MD signed contract with my company “Watters flooring” Fairfax, VA to install new carpets inside his company. I supervised my contractors who installs the flooring to make sure what we signed contract to install specifics.

    John Yeh stopped by and say hello. I was inspired by John with his kind spirit and good man. I worked Watters flooring for about one year before I obtained another employment.

    In fact, John Yeh recommended my company to Gallaudet University when Gallaudet was undergoing major renovation in 90’s. It was a major contract for me and my company to install new flooring and carpet. I went there and bought samples to people there who does contracts to the deaf owned companies. When you visit Old College hall where President’s office is now, Peet Hall, Ole Jim and student union building in the 90’s. Look at carpet and floor designs throughout the building. My company does that.

    Please look both sides before making the accusations.

    YEH is a scum of the earth. I still don’t believe that he will serve 5 years. I truly believe his son and daughter should go to jail as well since they knew what there father was doing. Irma encourage her daughter to marry there son cuz she wanted to make $$$$. The best part Irma and Joshua will be going to jail and they won’t have nothing when they come out. I truly believe that everyone at Galladuet should take moral and business ethnic class since most of thieves came from Galladuet who work with Viable. It’s unfortuately that a lot of people will suffer to get work and I got slander for the doing the right thing. I can live with my conscious but I truly don’t believe Irma and Yeh have any conscious.
